Our firm specialises in Consumer Law. One of the regular complaints we receive is from consumers who bought into a vacation scheme but now have no use for it any more, but have to keep paying ever increasing levies since the scheme doesn’t allow consumers to cancel.
In response to these consumers’ plight, we’ve developed new legal solutions based on consumer law. You’re not likely to find these solutions at other law firms. It’s taken us several years to develop and refine these strategies.
There are several types of holiday schemes:
Timeshare, such as Quality Vacation Club, The Holiday Club, FlexiClub and a myriad others. The consumer usually gets this based on contract, and we have various strategies to cancel these contracts. We’ve cancelled hundreds of timeshare contracts for South African consumers. We charge R6 989.13 to cancel your timeshare.
Shareblocks: this involves buying shares in a shareblock company which owns the holiday properties. You’ll know you bought into a shareblock scheme if you received a share certificate. This set-up is based on shareholding, so as a shareholder you need to either persuade someone to buy your shares or abandon your shares back to the company. We intervene by persuading the company to take back the shares either free of charge or to resell them and compensate the consumer. We charge a deposit of R10 752.50 to assist with a shareblock, unless we’ve previously dealt with that shareblock company, in which case the fee can be as low as R2 500.
Joint ownership schemes: the consumer is registered at the Deeds Office as one of the many co-owners of the vacation property. You’ll know you’ve bought into this type of scheme if you have a title deed. As a co-owner, you’d have to persuade someone to buy your portion of the property from you, which can be difficult, and then ensure it’s registered in their name. We intervene by persuading the managers to find a buyer and transfer your shares. We charge a deposit of R13 285.50 for this, unless we’ve previously dealt with that shareblock company, in which case the fee can be as low as R2 500.
Accommodation discount schemes like Vacation Hub International, My Travelution, Go Ortus, Global Travel Alliance, Easy Escapes etc . We’ve found that with many of these schemes, the discounts are not real and the contracts don’t comply with the law. We usually cancel these contracts by demonstrating that they were never lawful and so are invalid and so your fees paid over the years can be claimed back. We charge a deposit of R3 415.50 to cancel the contract, and a further R1 897.50 to claim your money back.
